Terms of Use

1. Provider and Scope
The provider of the Chopz service is Firntec GmbH, Fabrikstrasse 32, 3900 Gamsen, Switzerland (hereinafter « Firntec »). These Terms of Use govern the use of the Chopz service by operators of barbershops and hair salons (hereinafter « the customer »). Deviating terms of the customer apply only if Firntec expressly agrees to them in writing.
2. Description of Services
Chopz is software for appointment booking, for making free capacity (walk-ins) visible, and for communicating with end customers via WhatsApp. The service is under active development and is currently being trialled as a pilot with selected salons. The scope of features and the availability may change during this phase.
3. Conclusion of Contract
No contract is concluded via this website. A contractual relationship arises only through a separate, express agreement between Firntec and the customer.
4. Prices and Payment
The applicable prices are set out in the separate price list, which is provided when the contract is concluded. Charges are payable in advance for the upcoming billing period. Payment is processed via an external payment service provider.
5. Customer Obligations
The customer uses the service exclusively for lawful purposes and in accordance with applicable regulations. In particular, the customer ensures that the necessary consent of the individuals concerned is in place for communication with end customers via WhatsApp. The customer is solely responsible for the lawfulness of the content of the messages sent via the service, in particular for compliance with competition and advertising law.
6. Use of Third-Party Services
Chopz uses the WhatsApp Business Cloud API from Meta to deliver messages. The terms of the respective provider apply in addition to these third-party services. Firntec has no influence over the availability or function of these services.
7. Availability
During the development and pilot phase, no guaranteed service level (SLA) is assured. Firntec strives for high availability but cannot rule out interruptions for maintenance, further development, or for technical reasons.
8. Liability
Firntec is liable only for damages caused through gross negligence or intent. Otherwise, liability is excluded to the extent permitted by law. This applies in particular to indirect damages, lost profit, and loss of data.
9. Data Protection
The processing of personal data is governed by the Privacy Policy further down on this page.
10. Term and Termination
In regular operation, the contract can be terminated with 30 days' notice to the end of a calendar month. Separate arrangements may be agreed for the pilot phase.
11. Amendments
Firntec may amend these Terms of Use, in particular to align them with new features or legal requirements. The version in force at the time the contract is concluded or the service is used shall apply.
12. Applicable Law and Jurisdiction
Swiss law applies exclusively. The place of jurisdiction is Brig, Valais, unless mandatory statutory provisions require a different jurisdiction.
